All Seller-owned appurtenant water rights will convey to the new Buyer(s).
The Seller does not believe they own any appurtenant mineral rights, but they will convey any owned.
The deeded and leased lands have long been utilized for summer pasture. Portions of the deeded lands are also utilized as winter range during mild winters. At the Buyer(s) discretion, the Seller would entertain leasing back the grazing rights.
Eligible Buyers must apply with and be approved by the Bureau of Land Management (BLM) and/or the State Board of Land Commissioners to receive the mentioned permits. The permitted lands are not included in the sale nor is there any value in the purchase price associated with these permits. Tract 1: The Buyer of Tract 1 will receive a “Grazing Preference” from the BLM to the 2,603± acre, 170 AUMs, Peterson Draw BLM allotment.
Tract 5: The Buyer of Tract 5 will receive a “Grazing Preference” from the BLM to the 12,075± acre, 770 AUMs, Browns Draw BLM allotment.
Tract 8: Removed from the auction.
Tract 10: The Buyer of Tract 10 will receive a “Grazing Preference” from the BLM of the Seller’s portion of the shared Lay Creek EU BLM allotment. The Tract 10 Buyer’s portion is estimated at 105± acres, 34 AUMs.
Tract 11: The Buyer of Tract 11 will receive a “Grazing Preference” from the BLM of the Seller’s portion of the shared Lay Creek EU BLM allotment. The Tract 11 Buyer’s portion is estimated at 546± acres, 179 AUMs.
Tract 12: The Buyer of Tract 12 will receive a “Preferred Status” to obtain the Grazing Lease from the State of Colorado to the adjacent 639± acre section.
Summary of Terms:
- 10% earnest money deposit of the purchase price will be due immediately from all successful bidders.
- A 5% buyer’s premium will be added to the high bid to determine the total purchase price.
- The property is being sold “AS IS, WHERE IS” and without any contingencies, including financing.
